Simmons warranty - good to go?

Just bought a rifle that had a Simmons 44MAG  3-10x44 Wide Angle scope.  I wasn't expecting the scope to come with it so it was a bonus.
Problem is that on 3x it is clear but when turning the VERY loose power adjustment knob it gets very out of focuse as it gets into the higher mag settings - have tried adjusting the diopter but to no avail.
I'm wondering if Simmons would do warranty work on this scope - anyone have any experience with this?
I'll call them in the AM to check with them as well - but was just wondering what normally would happen in this case.

I recently had a 2.8X-10X-44MM Simmons Aetec (Phillipine manufacture---the good kind) develop similar symptoms plus it wouldn't hold zero. A telelphone call revealed Bushnell now owns Simmons and handles the warranty repairs on older Simmons scopes. When I sent it to Bushnell's repair facility, rather than repair it,  they replaced it with a new Bushnell Trophy XLT, a scope that one can buy over the counter for $110.00. The 44MM Aetec performed better in low light than my new 50MM Leup VX-3. Right now I'm not a happy camper. Time will tell whether the XLT measures up to the old Aetec.
