Scope or ring problem?

I have a new Bushnell Elite 3200 10x40 tactical scope. New Warne Maxima rings. I mount the scope on a Weaver 1pc base. Use a Warne torque wrench to tighten the ring screws to 25#. I attache the scope & tighten the bottom 2 screws & tighten the top 2 screws. Put rifle in a vice to line up & bore sight. The left to right adjustment works fine but the up/down does not move in the scope. The turret turns & clicks & the turret screw is tight. If I loosen the top 2 ring screws on both rings, the up/down works. Any ideas what's wrong?

Something internal with the scope. It seems you are not over tightening. Send it to Bushnell.

Midway agrees & is sending me a new scope. I tested further over the weekend by installing a 1" metal tube in place of the scope & cut it in half & lined up the cut ends as I tightened the rings. The halves lined up perfectly along the cut ends. I did this to see if the 1 piece base or the rings were somehow torquing the scope. Thanks.
