 NRA Sues Mayor Ray Nagin

 

Fairfax, VA-The National Rifle Association (NRA ) has filed a motion for contempt against the City of New Orleans, the mayor and the acting chief of police for failure to comply with a temporary restraining order, handed down September 12, 2005, ordering an end to all illegal gun confiscations.

"With looters, rapists and other thugs running rampant in New Orleans, Ray Nagin issued an order to disarm all law-abiding citizens," declared Wayne LaPierre, NRA executive vice president. "With no law enforcement and 911 available, he left the victims vulnerable by stripping away their only means of defending themselves and their loved ones. Now Ray Nagin thinks he's above the law, and that's just wrong."

Attorneys for NRA have exhausted all efforts to cooperate with the defendants, Mayor Nagin and Chief Riley, who repeatedly ignored the court's permanent restraining order against their illegal gun confiscations.  

"Ray Nagin is a colossal disappointment," said Chris W. Cox, NRA chief lobbyist. "During a federally declared emergency, he abused his power and abandoned the very people he was sworn to protect. He took away the victims' freedom and their basic means of self-defense during an ill-fated and perilous time."

The motion also includes an order that all seized firearms must be returned to their rightful owners.

I'm hope this legal action sends a message to other city leaders about stripping firearms from law-abiding citizens.

It's unbelievable that this "mayor"  and I use that term loosely, would do this to the citizens of his city, but I guess when you have the undivided attention of law enforcement in the city you control and you're not living as the residents of New Orleans had to, ya don't need a gun. (but I'd bet my next paycheck Nagin was carrying a firearm).  I've often wondered throughout that whole ordeal in New Orleans, how many meals Nagin missed, how many times was he thirsty or was his home or area where he stayed without power or protection? This guy was a complete failure when his city needed him most.....and as far as the ignorant statements he made about rebuilding a "choclate New Orleans", I wondered what would've happened if the tables were turned and a white mayor made the same statements? Don't get me wrong, I'm not a racist, but I don't believe anyone is "special" or should be treated that way due to race, religion or sex.

 

And another damn thing, I hope the NRA pushes the issue and Nagin is "dealt" with, but I doubt it. I hope their actions are pure and not just lip-service to appease the law-abiding gun owners of this nation.

 

Well, I've had my rant  for today.....have a nice weekend everyone.

NRA AND NEW ORLEANS REACH AGREEMENT ON RETURN OF FIREARMS CONFISCATED DURING KATRINA

 

NRA has negotiated an agreement with New Orleans regarding the firearms seized from lawful owners during and after Hurricane Katrina.  The issue is pending before the federal court in the case NRA v. Mayor Ray Nagin.  On March 15, 2006, lawyers for both sides informed the court that positive settlement negotiations were occurring.  After months of stonewalling, the city of New Orleans has now admitted that it holds a number of firearms, and that owners of firearms which may have been confiscated may contact the Property and Evidence Division of the New Orleans Police Department in any of the following ways:  by telephone, at (504) 658-5503; by mail, sent to:  New Orleans Police Department, Property and Evidence, 400 North Jefferson Davis Parkway, New Orleans, LA 70119; or in person at the same address.  Please be patient as records are incomplete, and the police are currently understaffed.  Records are most accessible if you can supply your gun's serial number.  Claims can be made based on proof of ownership, or, lacking such documents, an affidavit that the item belongs to you.  For those who go through the above process, whether successfully or unsuccessfully, NRA would be interested in hearing your comments on what occurred.  Please contact NRA Grassroots at 800-392-8683 or by email at https://secure.nraila.org/Contact.aspx.

CONGRESSMAN OUT TO BAN POST-KATRINA-TYPE GUN CONFISCATIONS . . . Rep. Bobby Jindal (R.-La.) has introduced legislation to amend federal emergency statute laws that would prevent local authorities from confiscating lawfully owned firearms during times of disaster. “Particularly during emergencies like those surrounding Hurricanes Katrina and Rita, when incidences of looting, violence and lawlessness were broadcast around the country, we must ensure that law-abiding gun owners are not deprived of their constitutionally protected right to bear arms,” Rep. Jindal said. Thirty-three states have “emergency powers” laws that give the government permission to suspend or limit gun sales and to prohibit or restrict citizens from transporting or carrying firearms. In some states, authorities can seize guns outright from citizens who have committed no crime.

DISREGARDS GUN OWNERS' RIGHTS

Law-abiding citizens of New Orleans who were forced to relinquish their legally owned firearms to the New Orleans Police Department (NOPD) will have to wait, indefinitely, to regain their property.  New Orleans officials revealed they have not returned any firearms, as Mayor Ray Nagin and the city have yet to set up a return process.

"Mayor Ray Nagin continues to deny freedom by denying lawful citizens their Second Amendment rights," stated NRA Executive Vice President Wayne LaPierre. "First, he confiscates law-abiding citizens' firearms and lies about it.  Then, he fails to comply with court orders.  Now he refuses to return the legally owned firearms to their rightful owners by dragging his feet.  It's a disgrace."

After denying the illegal confiscation for months, on March 15, 2006, Mayor Nagin and the NOPD conceded in federal court that they do have seized guns stored in locked steel containers. The city then agreed in court to a process by which law-abiding citizens may file a claim to receive their confiscated firearms.

However, a New Orleans official handling the gun confiscations stated that no guns have been returned because the NOPD requires background checks, and the city has not set up a process.  The official acknowledged, "We've been told it was going to happen weeks ago.and still hasn't been done."

NRA-ILA Executive Director Chris W. Cox stated, "During a time of chaos and lawlessness, Ray Nagin took away the only means of protection law-abiding citizens had, and by delaying necessary and appropriate action to right this wrong, he blatantly continues to disrespect New Orleans citizens.  The Mayor's contempt of court, his contempt of the Second Amendment, and his disrespect of the law-abiding gun owners of New Orleans is shameful."


NRA ANNOUNCES NEW ORLEANS TOWN HALL MEETING!

NRA will be holding a special Town Hall Meeting in New Orleans next week to spotlight and document the plight of the city's law abiding residents, who were forced to surrender their legally owned firearms in the chaotic aftermath of hurricane Katrina.

Residents who were victims of this injustice are encouraged to attend the meeting and share their stories.  This is an opportunity to tell NRA what the City of New Orleans did to trample your Second Amendment rights when you needed them most.

NRA Executive Vice President Wayne LaPierre, and NRA-ILA Executive Director Chris W. Cox will host the Town Hall Meeting.  Be sure to come out and tell them your story.

As reported in last week's Alert, on July 13, 2006, all 55 Republicans, joined by 28 Democrats and 1 Independent, voted to pass Senator David Vitter's (R-La.) amendment to prohibit the use of taxpayer funds allocated under the Homeland Security appropriations bill (H.R. 5441) to be used to confiscate lawfully-possessed firearms during an emergency or major disaster.  Sixteen Senators opposed the prohibition.

 

In passing this legislation, the United States Senate acted on a bi-partisan basis to protect the self-defense rights of citizens when those rights are most vital, in the aftermath of a major disaster, when law-abiding citizens are left to defend themselves and their families.

 

Sixteen Democrats (including both Senators from the states of California, Hawaii, Maryland, New Jersey, and New York) voted to defeat this commonsense legislation (Déjà vu Note:  Under the unblinking eye of the C-SPAN cameras, Senator John Kerry (D-Mass.) voted against the Vitter amendment, then minutes later he reversed course and voted for it.)  These extreme opponents of the Second Amendment are:

While the passage of Senator Vitter's Amendment is significant, enactment into law of the "Disaster Recovery Personal Protection Act of 2006" should remain our overarching goal.  Introduced as S. 2599 by Senator Vitter in the Senate, and H.R. 5013 by U.S. Representative Bobby Jindal (R-La.) in the House, this NRA-supported legislation would amend federal emergency statute laws to prohibit federal, state, and local authorities from confiscating lawfully-owned firearms during times of disaster.

UPDATE ON NRA'S LAWSUIT AGAINST THE CITY OF NEW ORLEANS

 

This week, in a landmark victory for NRA and law-abiding gun owners, Judge Carl J. Barbier of the U.S. District Court for the Eastern District of Louisiana denied the City of New Orleans' motion to dismiss NRA's lawsuit against the city.  Further, Judge Barbier held that the Second Amendment does apply to law-abiding residents in the State of Louisiana and the City of New Orleans.  Incredibly, the City of New Orleans persisted in desperately clinging to its anti-gun agenda by contemptuously arguing just the opposite--that the Second Amendment does not apply to residents in the State of Louisiana and the City of New Orleans.

 

NRA first filed suit after Hurricane Katrina, when firearms were confiscated from law-abiding New Orleans residents.  Former New Orleans Police Chief Eddie Compass issued orders to confiscate firearms from all citizens.  With that one order, the means of self-protection that innocent victims had during a time of widespread civil disorder was stripped away.

 

NRA filed suit in federal court and won a preliminary injunction ending these illegal gun confiscations.  After the City of New Orleans failed to comply with the court's ruling and falsely claimed that the gun confiscations never occurred, NRA filed a motion for contempt that included an order directing all seized firearms be returned to their rightful owners.

 

After strenuously denying the illegal confiscations for months, on March 15, 2006, Mayor Nagin and the New Orleans Police Department (NOPD) finally conceded in federal court that the seized firearms were stored in two trailers.  The city then agreed in court to a process by which law-abiding citizens would be able to file a claim to receive their confiscated firearms.  However, few firearms were returned because the NOPD never notified gun owners how to claim their guns, and turned many away citing impossible standards for proof of ownership.

Today's ruling sets the stage for a continued legal fight in which NRA will be forced to expend additional resources to fight back the anti-gunner's blatant and shameful attempts to ignore the Second Amendment.  The case will now move to discovery and pre-trial preparation.
