just got a ss 10x40 , with tps rings and one peice base, Question i have about mounting it. some say just mount it, others say get rings alligned,  i can mount it and bore sight it , but question is should i have someone allign my rings or will the rings alling when they are places one the one peice base?

By "align" the rings, do you mean lap the rings?  Lapping those rings will void the warranty, so don't lap the rings.

As a general rule, I snug the ring base on the rail (after you determine proper eye relief and best ring positioning) and place the scope into the lower ring halves.  If the scope slides freely in the ring halves, you are fine.  If the scope binds in the rings, there is a problem - it might be base, it might be rings, it might be scope tube.  Most times, the scope slides freely.

Try this and let me know if it binds or not.

If not, mount it, being sure to make the reticle align with the vertical axis of the bore.

It is typically not the rings that need aligned, at least if you are using good rings like TPS.  Most times the receiver of the gun itself is not straight so when you put the base(s) the ends are at different heights.  That is where alignment bars come in.  You can tighten your base(s) down attach your rings and put the bars in your rings and see if everything is square.  If it is not then you need to figure out where the problem is, whether the receiver, base or rings.  LIke I said it will most likely be the receiver and you will need to bed you base on one side with something like Devcon or JBweld. 

Here is a pic of a Savage rifle.  I have done several Remington and they were all off more than this and required bedding as well.
