Five South Dakota lawmakers have introduced legislation that would require any adult 21 or older to buy a firearm "sufficient to provide for their ordinary self-defense.”


The bill, which would take effect Jan. 1, 2012, would give people six months to acquire a firearm after turning 21. The provision does not apply to people who are barred from owning a firearm.

Nor does the measure specify what type of firearm. Instead, residents would pick one "suitable to their temperament, physical capacity, and preference.”

The measure is known as an act "to provide for an individual mandate to adult citizens to provide for the self defense of themselves and others.”

Rep. Hal Wick, R-Sioux Falls, is sponsoring the bill and knows it will be killed. But he said he is introducing it to prove a point that the federal health care reform mandate passed last year is unconstitutional.

"Do I or the other cosponsors believe that the State of South Dakota can require citizens to buy firearms? Of course not. But at the same time, we do not believe the federal government can order every citizen to buy health insurance,” he said.



HB 1237, introduced by Representatives Wick, Brunner, and Greenfield and Senators Rampelberg and Begalka. The full text of the bill is as follows:

FOR AN ACT ENTITLED, An Act to provide for an individual mandate to adult citizens to provide for the self defense of themselves and others.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. Not later than January 1, 2012, each citizen residing in the state of South Dakota who has attained the age of twenty-one years shall purchase or otherwise acquire a firearm suitable to their temperament, physical capacity, and personal preference sufficient to provide for their ordinary self-defense.
Section 2. After January 1, 2012, each citizen residing in the state of South Dakota shall comply with the provisions of this Act within six months of attaining the age of twenty-one years.
Section 3. The provisions of this Act do not apply to any person who is disqualified from possessing a firearm pursuant to §§ 22-14-15, 22-14-15.1, or 22-14-15.2.

Link to local news station.  It would be nice, but not sure I want some to have a gun (sure there is a provision as I have not read the law yet).  Great way of proving a point to some people.

SD is one of the 26 states the sued the Gov't over Obama care.  Judges ruled in their favor.

Wouldn't that be a great law.  I think the Montana Legislature just passed a bill requiring the Attorney General of Montana to join that suit.  Shouldn't have had to pass a bill, but thanks to our liberal governor, that is the way it works.

Sounds like a great law but our Liberal government in Ontario is more likely to mandate that you must support gay marriage.

Nice to know SD has all its other problems solved so the state legislature can waste taxpayer time/money with crap like this. FYI: that law making everybody buy into an insurance pool was originally a GOP idea, from back in the Clinton days. More recently, you might not know that Mitt Romney is a Republican - who as governor of Mass. helped write that same provision into his state's Obama-like health care plan. This SD lawmaker sound like an insurance co. whore; maybe those bright citizens (my ex-wife was from there) would like to go back to the days when co.'s like Wellpoint can arbitrarily raise some insurance premiums by 40% after a record-breaking (profit) quarter, as they did last year.
This gun owner despises panderers. If some politician lies about or unfairly slanders the opposition - regardless of which political "side" that person is on - then he's just another liar, not to be trusted. Not so sure this guy is pandering to gun owners or sucking-up to his ins. co. bosses more here, though.
Guess I'll scratch SD off my list for hunting trips from now on...

I'm thinking you're missing the point of the SD bill.  The sponsors know it will be killed, and that's precisely the point.  It helps illustrate hypocrisy on what sort of mandates the gov't can impose on people.

You're gonna have to provide a link on your contention that the healthcare law was originally a GOP idea.  That has been a Dem wet dream for decades.  I'm not implying that GOP is lily white on crap like this, but even if some GOP politician did support at one time or another, that idea has never had widespread GOP support.

I'm pretty sure this bill is NOT about guns. It relates to the BHO Gov't. Health care boondagle. If the Goobermint can mandate health insurance purchasing then why not "other" stuff like guns, etc. Get the point?
